The argument was heard Tuesday by a three-judge panel of the 2nd District Court of Appeal. Whether or not the vocals are indeed Jackson’s was not the purpose of Tuesday’s hearing, but rather whether the album’s liner notes and a video promoting it qualified as commercial speech, which, if they were would mean they are not protected by the anti-SLAPP statute. The slower tempo of the original allows for the vocals to create a more powerful mood against the propulsive rhythm section. He plays super fast, but also very precise and has surprisingly melodic leads. So despite the stellar vocals from Eric Hawk (sorta like John Bush) and killer riffs from Cat Andrew and Gill Neil, this solid album went somewhat unnoticed. Timing, geography and lack of touring likely hurt sales, but if you can get your hands on this you're in for a nice surprise.

All of the Beach Boys sang lead. As a writer/producer, Dennis was a sort. From 1968 on he also wrote several of the Beach Boys greatest seventies songs and his solo album Pacific Ocean Blue is the greatest solo album any Beach Boy ever did, including anything by Brian Wilson.
